My stay period has expired. How much is the fine, and what should I do?

Based on: National Law Information Center (국가법령정보센터) 「Enforcement Rules of the Immigration Act (출입국관리법 시행규칙)」 (Ministry of Justice Ordinance No. 1172, effective 2026.10.23.) Article 86 and [Attached Table 7] <amended 2026.1.23.> (checked 2026.10.30) · HiKorea 「Immigration/Stay Guide (출입국/체류안내)」 (revision date not confirmed) · 「Immigration Act (출입국관리법)」 (Act No. 21857, effective 2026.10.2.) · National Law Information Center, Enforcement Rules of the Immigration Act, [Attached Table 7] <amended 2020. 5. 29.> (web)

If your stay period has passed, you are now staying illegally. The longer it goes on, the bigger the fine gets, and it can hurt your next visa review. Please go in person to your local Immigration Office (출입국·외국인관서) as soon as possible. If your situation is complicated, we recommend first getting a consultation with the K-VISA AI Administrative Agent (K-VISA AI 행정사) (the Visa Service in the app).

How much is the fine?

  • The amount follows a standard table set by law, and it gets bigger the longer you stay past your period1.
  • The amounts in the 2020 standard table are as follows4.
  • Less than 1 month: 200,000 won
  • 1 to 3 months: 500,000 won
  • 3 to 6 months: 1,000,000 won
  • 6 months to 1 year: 2,000,000 won
  • 1 to 2 years: 5,000,000 won
  • 2 to 3 years: 10,000,000 won
  • The responsible agency looks at your age, the reason for the violation, your ability to pay, the number of violations, and so on. It can reduce or increase the standard amount by up to half1.

What should I do?

  1. You must get an extension permit before your original stay period ends. So you are already in violation now3.
  2. Bring your passport, Alien Registration Card (외국인등록증), and the documents for your visa status, and go to the Immigration Office with jurisdiction over your address2.
  3. If you apply for an extension after the expiry date, a fine will be charged2. Paying the fine does not guarantee an extension or that you can keep staying.
  4. Generally, depending on your situation, you may be told to leave the country instead of getting an extension.

⚠️ Things to note

  • The standard table changed in January 20261. The amounts above are from before that, so they may be different now. Please be sure to check.
  • This fine is not an administrative fine (과태료). It is money paid instead of a criminal penalty (벌금). Generally, if you do not pay, you may be reported and the case may move to criminal proceedings.
  • Be sure to check the exact amount and process at HiKorea (하이코리아) (hikorea.go.kr) or the Foreigner Comprehensive Guide Center (외국인종합안내센터) (1345).
