‹ Korea Visa & Stay Q&A for Foreigners
What must be included in the standard labor contract?
Based on: Enforcement Rule of the Act on Foreign Workers' Employment, etc. (「외국인근로자의 고용 등에 관한 법률 시행규칙」) (Ministry of Employment and Labor Ordinance No. 442, in effect 2025.6.2.) · Korea Law Information Center (국가법령정보센터) Labor Standards Act (「근로기준법」) (Act No. 21533, in effect 2026. 10. 8.) · Ministry of Employment and Labor (고용노동부) Employment Permit System (EPS) "Employment Permit System Information" (「고용허가제 정보」) (accessed 2026.10.29)The standard labor contract (Form No. 6 attached) includes the contract period, workplace, job duties, start and end times of work, holidays, break time, wages, and wage payment date. For agriculture, livestock, and fishing, use Form No. 6-2.
Please check these items
- Contract period — You agree on it with your employer within the 3-year period of employment activity
- Workplace (place of business) — Your employer must not make you work outside the workplace written in the contract
- Job duties — The contract states what work you will do
- Start and end times of work, break time — These are your daily working hours
- Holidays — These are the holidays under the Labor Standards Act
- Wages and payment date — You must also receive the wage components, calculation method, and payment method in writing
⚠️ Points to note
- When signing the contract, your employer must give you wages, working hours, holidays, and annual leave in writing (including electronic documents). The same applies if they change after the contract.
- Any condition worse than the Labor Standards Act is invalid for that part. Discrimination in working conditions because of nationality is also banned.
- A contract cannot say in advance that you will pay a penalty or damages if you break the contract.
- The probation period counts as length of service. Lowering conditions such as wages after probation violates the Labor Standards Act.
- You need a copy of the renewed labor contract when you apply for an extension. Your employer submits it to the local employment security office (Employment Center, 고용센터) with jurisdiction.
When you receive the contract, read it together with a translation in your native language. If you do not understand something, check with the Employment Center or the Foreign Resident General Information Center (외국인종합안내센터, 1345) before you sign.
